These Terms & Conditions ("Terms") are a legal agreement between you ("User", "Customer", or "you") and BudsBazaar ("we", "us", or "our"), governing your access to and use of the Platform. By browsing, registering, or purchasing on BudsBazaar, you agree to these Terms in full.

Acceptance of Terms
Agreement to These Terms
By accessing or using the BudsBazaar website (budsbazaar.in), mobile application, or any related service, you confirm that you have read, understood, and agree to be bound by these Terms & Conditions and our Privacy Policy. If you do not agree, you must not use our Platform.
Eligibility
You must be at least 18 years of age and capable of entering into a legally binding contract under the Indian Contract Act, 1872, to use BudsBazaar. By using the Platform, you represent and warrant that you meet these requirements. Minors may use the Platform only under the supervision of a parent or legal guardian who accepts these Terms on their behalf.
Modifications to Terms
BudsBazaar reserves the right to update or modify these Terms at any time. We will notify you of material changes by updating the 'Last Updated' date above and, where appropriate, by sending an email to your registered address. Continued use of the Platform after changes are posted constitutes your acceptance of the revised Terms.
Section 02
Use of the Platform
Permitted Use
BudsBazaar grants you a limited, non-exclusive, non-transferable, revocable licence to access and use the Platform for the sole purpose of purchasing individual earbud or charging case replacement parts for personal, non-commercial use.
Prohibited Activities
You agree not to: ⢠Use the Platform for any unlawful purpose or in violation of any applicable Indian or international law. ⢠Scrape, crawl, or systematically extract data from the Platform without our express written permission. ⢠Attempt to gain unauthorised access to any part of the Platform, our servers, or any system connected to the Platform. ⢠Post, transmit, or distribute any content that is defamatory, obscene, fraudulent, or infringes on any third party's intellectual property rights. ⢠Impersonate any person or entity, or falsely represent your affiliation with any person or entity. ⢠Use automated tools (bots, scrapers) to place orders, manipulate pricing, or abuse our promotions. ⢠Reverse-engineer, decompile, or disassemble any software used in connection with the Platform.
Account Responsibility
You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to notify us immediately at support@budsbazaar.in if you suspect any unauthorised use of your account. BudsBazaar is not liable for any loss resulting from unauthorised use of your account where you have failed to maintain reasonable security.
Section 03
Products & Listings
Product Accuracy
We make every effort to ensure that product descriptions, images, compatibility information, and pricing on the Platform are accurate and up to date. However, we do not warrant that product descriptions or other content are error-free. If a product you receive is materially different from its description, please contact us within 7 days of delivery.
Compatibility
Our search and filter tools are designed to help you identify compatible parts for your specific earbud model. However, it is your responsibility to verify compatibility before completing a purchase. BudsBazaar is not liable for purchases made for incompatible models where the product description accurately stated the compatible models.
Availability & Pricing
All products are subject to availability. Prices are displayed in Indian Rupees (INR) and are inclusive of applicable GST unless stated otherwise. We reserve the right to change prices at any time without prior notice. In the event of a pricing error, we will notify you before dispatching your order and give you the option to proceed at the correct price or cancel for a full refund.
Counterfeit & IP Policy
BudsBazaar is committed to selling only genuine OEM or certified compatible replacement parts. We prohibit the listing or sale of counterfeit goods. If you believe a product listed on our Platform infringes your intellectual property rights, please contact legal@budsbazaar.in with supporting documentation.
Section 04
Orders & Payments
Order Placement
Placing an order on BudsBazaar constitutes an offer to purchase the selected product(s) at the stated price. Your order is accepted and a contract is formed only when we send you an Order Confirmation email. We reserve the right to refuse or cancel any order for reasons including product unavailability, payment failure, suspected fraud, or errors in product or pricing information.
Payment Methods
We accept UPI, credit/debit cards (Visa, Mastercard, RuPay), net banking, popular wallets (Paytm, PhonePe, Google Pay), and Cash on Delivery (COD) for eligible pin codes. All online payments are processed through our PCI-DSS compliant payment partners. BudsBazaar does not store your full card details.
GST & Invoicing
All prices on the Platform include applicable GST. A GST-compliant invoice will be emailed to you upon order confirmation. If you require a business invoice with your GSTIN, please add your GSTIN to your account profile before placing the order.
Failed Payments
If a payment fails after your order is submitted, your order will not be confirmed. Any amount debited from your account in a failed transaction will be refunded by your bank within 5ā7 business days. BudsBazaar is not responsible for delays caused by your bank or payment provider.
Cash on Delivery
COD orders require payment in cash (exact change preferred) upon delivery. Our delivery partner may decline to hand over the package if full payment is not made at the time of delivery. COD availability is subject to your pin code and order value.
Section 05
Shipping & Delivery
Delivery Timelines
Orders are typically dispatched within 1 business day of payment confirmation. Standard delivery across India takes 3ā5 business days depending on your location. Express delivery options may be available at checkout for select pin codes. Delivery timelines are estimates and may be affected by public holidays, weather, or carrier disruptions.
Shipping Charges
Shipping is free on orders above ā¹999. Orders below ā¹999 attract a flat shipping fee displayed at checkout. COD orders may include an additional handling fee. Shipping charges are non-refundable unless the return is due to our error or a defective product.
Delivery Attempts
Our delivery partners will attempt delivery up to two times at your provided address. If delivery fails due to an incorrect address, your unavailability, or refusal to accept the package, the order will be returned to us. Re-delivery charges may apply. BudsBazaar is not responsible for delivery failures caused by incorrect address information provided by you.
Risk of Loss
Risk of loss and title for products purchased on the Platform pass to you upon delivery to your provided shipping address. If a package is lost in transit, please contact us at support@budsbazaar.in within 10 days of the expected delivery date and we will initiate an investigation with the carrier.
Section 06
Returns & Refunds
Return Window
You may return any product within 7 days of delivery if it is defective, damaged in transit, or significantly different from what was described. Returns are not accepted for products that have been used, damaged by the customer, or returned without original packaging.
Return Process
To initiate a return, log in to your account, navigate to 'My Orders', select the relevant order, and click 'Request Return'. You will receive a prepaid return shipping label within 24 hours if your return request is approved. Do not ship the product back without an approved return request.
Refunds
Approved refunds are processed within 2 business days of us receiving and inspecting the returned product. Non-Returnable Items
The following cannot be returned: products returned after 7 days of delivery, items without original packaging, products showing signs of use or physical damage caused by the customer, and items purchased under a 'Final Sale' or 'Non-Returnable' tag.
Warranty
All products sold on BudsBazaar carry a 30-day limited warranty against manufacturing defects. This warranty does not cover physical damage, liquid damage, or damage caused by incompatible use. Warranty claims must be raised within 30 days of delivery through our support portal.

Intellectual Property
Our Intellectual Property
The BudsBazaar name, logo, taglines, website design, code, graphics, and all content published on the Platform are the exclusive property of BudsBazaar and its licensors, protected under Indian and international intellectual property laws. You may not reproduce, distribute, or create derivative works from any part of the Platform without our prior written consent.
Brand References
References to third-party brand names (Apple, Samsung, Sony, Boat, JBL, Realme, OnePlus, Nothing, etc.) are used solely for product identification and compatibility purposes. BudsBazaar is not affiliated with, endorsed by, or sponsored by any of these brands unless explicitly stated.
User Content
If you submit reviews, photos, or other content on our Platform, you grant BudsBazaar a non-exclusive, royalty-free, worldwide licence to use, reproduce, and display that content for marketing and operational purposes. You represent that you own or have the right to submit such content and that it does not infringe any third party's rights.
Section 08
Limitation of Liability
Disclaimer of Warranties
The Platform and all products are provided 'as is' and 'as available'. To the fullest extent permitted by applicable law, BudsBazaar disclaims all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement.
Limitation of Damages
To the maximum extent permitted by Indian law, BudsBazaar's total liability to you for any claim arising out of or relating to these Terms or your use of the Platform shall not exceed the amount you paid for the order giving rise to the claim. In no event shall BudsBazaar be liable for indirect, incidental, special, consequential, or punitive damages.
Force Majeure
BudsBazaar shall not be liable for any delay or failure to perform resulting from causes beyond our reasonable control, including natural disasters, pandemics, government actions, strikes, internet outages, or carrier failures.

Governing Law & Disputes
Applicable Law
These Terms shall be governed by and construed in accordance with the laws of India, including but not limited to the Information Technology Act, 2000, the Consumer Protection Act, 2019, and the Digital Personal Data Protection Act, 2023.
Dispute Resolution
In the event of any dispute, claim, or controversy arising out of or relating to these Terms or your use of the Platform, both parties agree to first attempt resolution through good-faith negotiation. If the dispute is not resolved within 30 days of written notice, either party may escalate to mediation or arbitration.
Arbitration
Any unresolved dispute shall be referred to binding arbitration under the Arbitration and Conciliation Act, 1996. The arbitration shall be conducted in English by a sole arbitrator. The seat of arbitration shall be [Your City], India. The arbitral award shall be final and binding on both parties.
Consumer Rights

Termination by You
You may delete your account at any time through your account settings or by contacting support@budsbazaar.in. Deletion of your account does not affect any orders already placed or any legal rights or obligations that have already arisen.
Effect of Termination
Upon termination, your right to use the Platform ceases immediately. Provisions of these Terms that by their nature should survive termination (including intellectual property rights, limitations of liability, and dispute resolution) shall survive.

Miscellaneous
Entire Agreement
These Terms, together with our Privacy Policy and any other policies referenced herein, constitute the entire agreement between you and BudsBazaar with respect to your use of the Platform and supersede all prior agreements, understandings, or representations.
Severability
If any provision of these Terms is held to be invalid, illegal, or unenforceable by a court of competent jurisdiction, that provision shall be modified to the minimum extent necessary to make it enforceable, and the remaining provisions shall continue in full force and effect.
Waiver
Failure by BudsBazaar to enforce any right or provision of these Terms shall not constitute a waiver of that right or provision. Any waiver must be in writing and signed by an authorised representative of BudsBazaar.
Assignment
You may not assign or transfer any of your rights or obligations under these Terms without our prior written consent. BudsBazaar may assign its rights and obligations without restriction, including in connection with a merger, acquisition, or sale of assets.
